Ripple’s chief legal officer, Stuart Alderoty, stated that the SEC's appeal does not contest the ruling that XRP is not classified as a security. On October 16, the SEC filed a civil appeal regarding elements of the court's summary judgment in favor of Ripple. This appeal, noted by Ripple’s attorney James Filan, seeks to address actions related to XRP sales on exchanges and personal sales by Ripple executives Brad Garlinghouse and Chris Larsen. Alderoty highlighted that the ruling on XRP’s status remains unaffected, describing it as 'the law of the land.' According to reports, Ripple plans to file its own Form C appeal shortly after the SEC's filing. The ongoing legal process between both parties is expected to last until at least July 2025. In August 2023, Judge Analisa Torres determined that XRP is not a security when traded on digital asset exchanges, although Ripple was fined $125 million for related violations of securities law.
